    El mayor uso de la policía administrativa para combatir el discurso del odio constituye una controvertida novedad. Parece iniciarse un cambio de paradigma. Una nueva legislación no contempla ya al poder judicial como el garante último de los derechos fundamentales. El garante será ahora las Administraciones públicas. Se estudia las causas de esta paulatina sustitución y las amenazas que ello pueden conllevar a la libertad religiosa. La jurisdicción contencioso-administrativa está corrigiendo esta hiperactividad sancionadora con una incipiente jurisprudencia garantista.

    The increased use of administrative policing to combat hate speech is a controversial novelty. It means a paradigm shift. The judiciary doesn't act anymore as the guarantor of the fundamental rights. The guarantor will now be the public administrations. This paper focuses on the reasons which explain the gradual replacement and the threats that this replacement may result in the religious freedom. The administrative courts are correcting this sanctioning hyperactivity of the public administrations trough the adoption of jurisprudence that guarantees the protection of the religious freedom.
