El Auto del Tribunal Supremo resuelve con acierto el conflicto negativo de competencia planteado entre un juzgado de Bilbao y otro de Santoña, en relación a la solicitud de exequátur de una decisión judicial dictada en origen por un tribunal de EEUU. La fundamentación jurídica del Auto del Tribunal Supremo es correcta al seleccionar con acierto el bloque normativo interno (Ley 20/2015, de 30 de julio, de Cooperación Jurídica Internacional en Materia Civil) como cauce legal a través del cual resolver tal solicitud, al provenir la decisión judicial de los tribunales de un tercer Estado (en este caso, EEUU) no miembro de la UE, y con el que no existe convenio multilateral o bilateral aplicable al supuesto.
The Order of the Supreme Court correctly resolves the negative conflict of jurisdiction raised between a court in Bilbao and another in Santoña, in relation to the request for exequatur of a judicial decision issued originally by a US court. The legal basis of the Supreme Court Order is correct when selecting the internal regulatory block (Law 20/2015, of July 30, on International Legal Cooperation in Civil Matters) as the legal channel through which to resolve such request, when proceeding the judicial decision of the courts of a third State (in this case, the US) that is not a member of the EU, nor with which there is a multilateral or bilateral agreement applicable to the case.
