he new regulation on the acquisition of telephone records, imposed by the European Union’s warnings, constitutes an evolutionary moment in the guarantees that govern the matter. However, the reform shows deficiencies, above all for not having filled the void in the discipline regarding the possibility of verifying the truthfulness of the evidence contained in the telephone record. What is missing is the power of disproof; a legislative option that is not very compatible with a cognitive ideology.

Il novum legislativo sull’acquisizione dei tabulati telefonici, imposto dai moniti eurounitari, costituisce un momento evolutivo delle garanzie che presidiano la materia. Tuttavia, la riforma mostra carenze soprattutto per non aver colmato il vuoto di disciplina sulla possibilità di verificare la veridicità dell’informazione probatoria veicolata nel tabulato. Quel che viene così a mancare è il potere di confutazione; opzione legislativa poco compatibile con una ideologia cognitivista
