Ratificación judicial de la implantación del certificado covid como una medida de control sanitario: ¿cara o cruz?

    Desde que desatara la crisis sanitaria ocasionada por el virus del Covid-19, el derecho de necesidad ha inundado el panorama jurídico, permitiendo ahondar en los principios y los límites que rigen en su extraordinaria implementación. De este modo, tras la finalización del estado de alarma el 9 de mayo de 2021, las Comunidades Autónomas se han servido de los instrumentos jurídicos que les dotaba el ordenamiento para intentar controlar y frenar la expansión del virus. Así, de forma reciente, el certificado Covid digital se ha convertido en un (aparente) aliado de la gestión la crisis sanitaria, con el objetivo de evitar medidas más restrictivas (como el cierre de establecimientos), o limitativas de derechos y libertades fundamentales (como el confinamiento general de la población). Sin embargo, la ratificación judicial de esta medida ha tenido distintas respuestas, tanto por los Tribunales Superiores de Justicia, así como también por el propio Tribunal Supremo, los cuales han sentenciado acerca de si se cumplen con los caracteres de idoneidad, necesidad y proporcionalidad necesarios.

    Since the unleashing of the health crisis caused by the Covid-19 virus, the right of necessity has flooded the legal landscape, allowing for a deepening of the principles and limits governing its extraordinary implementation. Thus, following the end of the state of alarm on 9 May 2021, the Autonomous Communities have made use of the legal instruments available to them to try to control and halt the spread of the virus. Thus, recently, the digital Covid certificate has become an (apparent) ally in the management of the health crisis, with the aim of avoiding more restrictive measures (such as the closure of establishments), or measures that limit fundamental rights and freedoms (such as the general confinement of the population). However, the judicial ratification of this measure has had different responses, both by the High Courts of Justice, as well as by the Supreme Court itself, which have ruled on whether the necessary characteristics of suitability, necessity and proportionality have been met.
