Resumen de La hipoteca rezagada en el concurso: cuestiones civiles y registrales

En los últimos años, la doctrina ha alumbrado una nueva clase de hipoteca, «la hipoteca rezagada», que no contemplan los manuales clásicos de Derecho civil ni los de Derecho hipotecario, pero que refleja de manera muy plástica la realidad que subyace a esta figura: una hipoteca cuyo título constitutivo se formaliza antes de la declaración de concurso pero pretende inscribirse después de dicha declaración (en este sentido «rezagada») y, por tanto, en un momento en el que las facultades patrimoniales del deudor se hallan sometidas a las limitaciones que contemplan los artículos 106 y 107 TRLC. En el trabajo se explican con detalle las cuestiones prácticas que subyacen a esta figura, ya que aunque, como veremos, la hipoteca puede inscribirse después de dicha declaración, no gozará de privilegio en el concurso, lo que suscita ciertas dificultades a la hora de determinar el régimen aplicable y si el juez del concurso puede acordar su cancelación.

In recent years, the legal doctrine has given birth to a new kind of mortgage (« the lagging mortgage») which is not foreseen in the classic manuals of Civil Law or Mortgage Law, but which reflects in a very plastic way the reality that underlies this figure: a mortgage formalized before the declaration of insolvency which is intended to be registered after this moment, at a time when the debtor’s patrimonial faculties are subject to the limitations according to the articles 106 and 107 of the consolidated text of Spanish Insolvency Law. This work explains in detail the practical issues that underlie this figure. As we will see, this mortgage can be registered after the declaration of insolvency but the secured credit has not preference in the collateral. This feature raises some difficulties when determining the applicable regime, including its cancellation.
