Resumen de La legislación divergente alemana y su posible introducción en la legislación española

  La legislación divergente es una tipología competencial introducida en la norma suprema alemana a raíz de su reforma en septiembre de 2006.

  En este trabajo voy a analizar los aspectos fundamentales-concepto, regulación, alcance, materias, límites y las ventajas e inconvenientes- de la legislación divergente.

  Finalmente, partiendo de esta técnica alemana que otorga a los Länder la posibilidad de regulación diferente a la establecida por la normativa federal sobre una misma materia, intentaré mostrar en este trabajo los beneficios que podría reportar su introducción en el sistema de distribución de competencias de la Constitución Española.

  The divergent legislation is a typology competencial entered in the supreme norm German as a result of his reform in 2006.

  In this work go to analyse the fundamental appearances-concept, regulation, scope, matters, limits and the advantages and inconvenient- of the divergent legislation.

  Finally, splitting of this German technician that awards to the Länder the possibility of different regulation to the established by the federal rule on a same matter, will try to show in this work the profits that could report his introduction in the system of distribution of competitions of the Spanish Constitution
