La libertad sindical es un concepto regulado en la Constitución de 1978 y que ha sido ampliamente interpretado por los tribunales, especialmente por el Tribunal Constitucional. En cuanto a su régimen jurídico y sus múltiples clasificaciones, tradicionalmente se ha dividido entre derechos incluidos en este concepto de tipo individual o colectivo, según se refiera a los trabajadores individualmente considerados o a los sindicatos. Respecto a la denominada libertad sindical individual se han de tener en cuenta aspectos relativos a sujetos que presentan total libertad para su ejercicio, colectivos totalmente excluidos, así como personas con ciertas limitaciones en su ejercicio. Finalmente, es necesario analizar el contenido de este derecho a la libertad sindical individual y sus diferentes manifestaciones.

Freedom of association is a concept regulated in the Spanish constitution and which has been widely interpreted by the courts, especially by the constitutional court. Regarding its legal regime and its multiple classifications, it has traditionally been divided between rights included in this concept of individual or collective type, depending on whether it refers to the employees individually considered or to the unions. Concerning the so-called individual freedom of association, aspects related to subjects who have total freedom to exercise it, groups totally excluded, as well as people with certain limitations in their exercise must be considered. Finally, it is necessary to analyze the content of this right and its different manifestations.
