    Il presente articolo analizza dal punto di vista giuridico e retorico l’ottava novella della decima giornata del Decameron. Si dimostra che l’autore, in modo assolutamente indipendente dalle sue fonti, ha scritto la novella con sapienza di giurista, tale da restituire al lettore una precisa ricostruzione della repressione a Roma dell’omicidio commesso dal peregrinus nella seconda metà del I sec. a.C., ma anche di altri istituti, come quello del matrimonio canonico, in modo storicamente coerente. Pertanto il presente contributo, analizzando gli istituti romanistici e canonistici della novella in parola e lo stile impiegato da Boccaccio per rappresentarli, dà prova dell’alto livello della conoscenza del diritto posseduta dallo scrittore e di come questa conferisca un vigoroso realismo alla narrazione

    This article examines the eighth novella of Decameron’s tenth day from both a legal and a rhetorical standpoint. It demonstrates how, regardless of his sources, the author wrote this novella relying on his extensive legal erudition and presented the reader with both a precise and historically coherent re-enactment of the repression of the murder committed by the peregrinus in the second half of the 1st century b.C. in Rome, and of other institutions, such as that of the canonical marriage. Hence, by analysing the Romanistic and canonistic institutions of the novella, as well as the style used by Boccaccio to depict them, this paper gives evidence of the writer’s profound knowledge of legal matters, and of how it substantiates the realism of the story
