Resumen de Autoridad y disenso en la Corte Interamericana de Derechos Humanos

La resistencia hacia los tribunales internacionales ha recibido mucha atención académica. En general, ella se examina como un fenómeno que proviene desde fuera, esto es, desde Estados disconformes con ciertas decisiones. Pero también puede provenir “desde dentro”, esto es, cuando los propios miembros del tribunal no solo tienen desacuerdos interpretativos, sino que impugnan la manera como la Corte articula su autoridad judicial. Aquí, examino brevemente dos áreas en las que se produce esta interacción y la conecto con el contexto más reciente de ataques hacia el sistema interamericano, con el objeto de comenzar una discusión sobre el alcance de las interpretaciones que se hacen y cómo ellas pueden ampliar la jurisprudencia, pero al costo de exponer la autoridad del tribunal.

Legal scholars have paid significant attention to backlash and resistance against international tribunals. In general, the phenomenon is examined as coming from the outside, that is, from states dissatisfied with certain judgments. Resistance, however, may also come “from within,” when members of the tribunal themselves not only have interpretive disagreements, but challenge the way in which the Court shapes its authority. In this short work, I briefly examine two areas in which this interaction occurs and connect it to the more recent context of resistance against the Inter-American human rights system in order to begin a discussion about how the Court’s expansive interpretations may expand its jurisprudence, but ultimately at the cost of exposing the Court’s authority.
