El acceso a las prestaciones de Seguridad Social de los extranjeros británicos en España desde el año 2021

    En materia de asistencia sanitaria y de acceso y reconocimiento de las pensiones de Seguridad social, desde el 1.01.2021, los ciudadanos nacionales del Reino Unido residentes en España estaban excluidos del Reglamento comunitario de coordinación de los sistemas de seguridad social entre los Estados Miembros.

    El objeto de estudio del presente artículo son las medidas legislativas de urgencia que entraron en vigor en enero 2021, en lo relativo al marco normativo comunitario (relaciones basadas en el derecho internacional) como al nacional.

    Por un lado, el Acuerdo de Comercio y Cooperación entre la Unión Europea y la Comunidad Europea de la Energía Atómica, por una parte, y el Reino Unido de Gran Bretaña e Irlanda del Norte, (con fecha de entrada en vigor del Acuerdo el 1 de mayo de 2021 establece las cuestiones sociales y de coordinación de Seguridad social entre la Unión Europa y el Reino Unido); y por otro lado, el Real Decreto-Ley 38/2020 (con fecha de entrada en vigor del 1 de enero 2021 las cuestiones internas entre la Administración de la Seguridad social y los ciudadanos del Reino Unido).

    En este año de aplicación, han surgido problemas de aplicación y restricciones en el reconocimiento de prestaciones, se está a la espera a la espera de un convenio bilateral de Seguridad Social con el Reino Unido sobre la materia, sin que el convenio del año 1975 (BOE 31.03.1975) pueda volver a retomar vigencia al haber sido anulado por el Reglamento comunitario de Coordinación de Seguridad Social.

    Se analiza, pues, los nuevos requisitos que se les exigirán a tales ciudadanos británicos en España para el acceso a la asistencia sanitaria y pensiones a partir del año 2021, así como el apunte de las cuestiones problemáticas que ya se apuntan, y que deberá resolver el futuro convenio bilateral de Seguridad Social.

    As regards health care and access to and recognition of social security pensions, from 1.01.2021, UK nationals resident in Spain were excluded from the Community Regulation on the coordination of social security systems between Member States.

    The subject of this article is the emergency legislative measures that entered into force in January 2021, in terms of both the EU regulatory framework (relations based on international law) and the national framework.

    The Trade and Cooperation Agreement between the European Union and the European Atomic Energy Community, on the one hand, and the United Kingdom of Great Britain and Northern Ireland (entry into force of the Agreement on 1 May 2021, which establishes social security coordination issues between the European Union and the United Kingdom), and on the other hand, Royal Decree-Law 38/2020 (entry into force on 1 January 2021, which establishes the internal issues between the Social Security Administration and the citizens of the United Kingdom).

    In this year of application, problems of implementation and restrictions have arisen in the recognition of benefits, and we are awaiting a bilateral Social Security agreement with the United Kingdom on the matter, without the 1975 agreement (BOE 31.03.1975) being able to resume its validity, as it has been annulled by the Community Regulation on the Coordination of Social Security.

    It therefore analyses the new requirements that will be required of such British citizens in Spain for access to health care and pensions from 2021, as well as the problematic issues that have already been pointed out, and which will have to be resolved by the future bilateral agreement on Social Security.
