    En este artículo se hace una crítica a la ausencia en el Tratado de Libre Comercio de América del Norte (TLCAN) de una de las grandes cuestiones que es la migración laboral mexicana en Estado Unidos, sea ésta indocumentada o legal. Se afirma que esta ausencia responde a un acuerdo tácito establecido entre ambos gobiernos, anterior a la negociación del TLCAN, para no reglamentar sobre dicha migración, bajo el supuesto de que el libre comercio será la solución a este problema, alargo plazo. De esta manera, el autor realiza un recorrido por las etapas que ha pasado el tema de la migración mexicana a Estados Unidos en el marco del TLCAN, explicando el impacto y la dimensión migratoria ante las políticas en la materia por parte de los gobiernos mexicano y estadounidense.

    The author makes a critic and gives the explanation about the absence of the Mexican migration to US theme inside NAFTA, the legal one or the illegal. He affirms that the absence is due to an agreement between governments, Mexican and the US one before NAFTA was negotiated, to not make rules about the theme supposing that the free trade would be the solution for migration long-term. So, the author makes an explanation about the different stages of Mexican migration problem has passed around NAFTA, explaining the impact and the migratory dimension in face of Mexican and US migration politics.
