O artigo pretende analisar as divergências de interpretação nas Cortes Estaduais e Federais sobre a transfusão de sangue em Testemunhas de Jeová. Nota-se um conflito entre direitos fundamentais: o direito à vida e a liberdade religiosa. O caso foi admitido na Suprema Corte – Repercussão Geral nº 1.212.272 – em 2019 e até o momento não foi julgado. Assim, a pesquisa visa fazer um comparativo entre as orientações do Conselho Federal de Medicina, dispositivos constitucionais e, também, com algumas jurisprudências igualmente conflitantes sobre o tema.

The article intends to analyze the differences in precedents interpretation between States about the blood transfusion in Jehovah's Witnesses. There is a conflict in the fundamental rights admitted to the Magna Charter, between the right to life and religious freedom. The case was admitted by the Supreme Court - General Repercussion nº 1.212.272 - in 2019 and so far it was not judged. Thus, the research aims to make a comparison between the guidelines of the Federal Medical Council, constitutional devices, and also, with some equally conflicting precedents on the subject
