Intervencionismo e injerencias de la autoridad eclesiástica en el derecho de asociación: Estudio de casos

    En este artículo se concreta, de una parte, lo que comporta la libertad o derecho de asociación en la Iglesia; y, de otra, las facultades de la autoridad eclesiástica respecto de las asociaciones de fieles (vigilancia, visita y régimen), sobre todo para resaltar que tales competencias no pueden dificultar el derecho de asociación, ni mucho menos limitarlo, sustituirlo o reordenarlo a su capricho. Más bien al contrario, deben animarlo, acompañarlo, orientarlo, seguirlo, … en definitiva, cuidarlo. Con esta finalidad, se analiza el ius statuendi contenido en el canon 94 § 1 y se reflexiona sobre la necesidad de conciliar el derecho de asociación con las facultades que compete a la autoridad eclesiástica, para buscar un equilibrio que guíe la relación de los miembros de una asociación con la jerarquía, en un ejercicio de corresponsabilidad eclesial que el papa Francisco llama sinodalidad, invitando a unos y otros a caminar juntos en la misión evangelizadodra que todos tenemos como miembros de la Iglesia, Pueblo de Dios.

    This article specifies, on the one hand, what freedom or the right of association in the Church entails; and, on the other hand, the faculties of the ecclesiastical authority with respect to the associations of the faithful (vigilance, visitation and regime), above all to highlight that such competences cannot hinder the right of association, much less limit it, replace it or reorder it to its own whim. Rather on the contrary, they should encourage him, accompany him, guide him, follow him,… in short, take care of him. To this end, the ius statuendi contained in canon 94 § 1 is analyzed and the need to reconcile the right of association with the faculties that corresponds to the ecclesiastical authority is reflected, in order to seek a balance that guides the relationship of the members of an association with the hierarchy, in an exercise of ecclesial co-responsibility that Pope Francis calls synodality, inviting one and the other to walk together in the evangelizing mission that we all have as members of the Church, the People of God.
