Se analiza la posibilidad y las limitaciones en el uso de la tecnología de registro distribuido, con el formato de cadena de bloques y creación de tokens, para la emisión, transmisión y gestión de valores anotados en cuenta. Asimismo, se examina la posibilidad de aplicar el régimen jurídico de los valores negociables a los criptoactivos representados y negociados como tokens o fichas. El estudio se lleva a cabo sobre la base de la vigente Ley del mercado de valores y la Propuesta MiCA (Markets in Crypto-assets: mercados de criptoactivos) de la Unión Europea.

This paper analyzes the possibility and limitations in the use of distributed lodger technology, with the blockchain format and token creation, for the issuance, transfer, and management of book-entry securities. Likewise, the possibility of applying the legal regime of negotiable securities to crypto-assets represented and negotiated as tokens is examined. The study is carried out on the basis of the current Securities Market Act and the MiCA Proposal (Markets in Crypto-assets) of the European Union.
