En esta aportación se identifica al Estado con la Constitución. Mediante el sistema analítico y comparativo se advierten las similitudes existentes entre los elementos del Estado y los ámbitos de validez de la norma constitucional, llegando a concluir, que Estado y Constitución son conceptos que corresponden a un mismo ente.El trabajo se desarrolla desde un punto de vista estrictamente jurídico, sin pretender abordar otras materias relacionadas, como la sociología o la política. Kelsen identificó al Estado con el derecho en general. En las siguientes líneas, nos apartamos parcialmente de dicho supuesto, para asentar la identificación en exclusiva con la Constitución, haciendo coincidir ambos conceptos.

In this contribution identify the State with the Constitution. Through the analytical and comparative system, we notice the existing similarities between the elements of the State and the ambits of validity of the constitutional norm, coming to conclude that State and Constitution are the same thing.The work is developed from a strictly legal point of view, without pretending to address other related areas, like the sociology or the political. kelsen identified the State with the legal order in general. In the next lines, we move away partially from that assumption, for to hold in exclusive, the identify between State and Constitution, and to do coincide both concepts.
