    La Constitución Política vigente no precisa el mecanismo de incorporación de las normas internacionales en el orden interno, ni la obligatoriedad de los tribunales de aplicarlas. Se recomienda que en la nueva Constitución las relaciones entre el derecho internacional y el interno se regulen con mejor determinación, reafirmando el compromiso de Chile con los derechos humanos y su realización efectiva. Se argumenta a favor de la inclusión de técnicas de implementación que permitan la articulación entre las normas de uno y otro ordenamiento, en vez de su anulación recíproca.

    The current Political Constitution does not specify the mechanism of incorporation of international norms in the internal order, nor the obligation of the courts to apply them. It is recommended that in the new Constitution the relations between international and domestic law be regulated with better determination, reaffirming Chile's commitment to human rights and their effective realization. It is argued in favor of the inclusion of implementation techniques that allow the articulation between the norms of one and the other legal system, instead of their reciprocal invalidation.
