Resumen de La cuestión de los límites a los derechos fundamentales ante un nuevo proceso constituyente

Ante el nuevo proceso constitucional chileno este trabajo se propone abordar cómo podría incorporarse la cuestión de los límites a los derechos fundamentales y, especialmente, qué aspectos debieran ser objeto de debate en ese marco. Para eso la regulación sobre los límites en la CADH será presentada como contexto, a la vez que se introducirán algunos de los principales puntos críticos que esta materia posee, con la perspectiva de su reflexión y definición textual en esta nueva Constitución.

Under the new Chilean constitutional process, this paper aims to address how the issue of the fundamental rights limits could be incorporated and, particularly, what points should be subject to debate in this framework. For that, the regulation of the limits in the ACHR will be presented as a context, and, at the same time, some of the main critical points in this matter will be introduced with the purpose of its reflection and a textual definition in this new Constitution.
