    En relación con los efectos que la declaración de concurso proyecta sobre los contratos celebrados por el concursado, la rehabilitación constituye una manifestación específica de la incidencia que la situación concursal puede tener sobre el normal funcionamiento de la facultad de resolución de los contratos. Dentro del elenco de contratos susceptibles de ser rehabilitados, con la finalidad fundamental de facilitar la continuidad de la actividad empresarial del deudor, conforme al artículo 166 del Texto Refundido de la Ley Concursal expresamente se incluyen los contratos de financiación. En este contexto, el objeto de este artículo es analizar el régimen de la rehabilitación de este tipo de contratos, distinguiendo en este sentido los diversos presupuestos y requisitos que para llevar a cabo esta rehabilitación han de cumplirse, así como el derecho de oposición a la rehabilitación del acreedor concursal.

    In relation to the effects that the declaration of insolvency projects on the contracts concluded by the bankrut the rehabilitation constitutes a specific manifestation of the impact that the insolvency situation may have on the normal functioning of the power to terminate the contracts. Within the range of contracts that are susceptible of being rehabilitated, with the main purpose of facilitating the continuity of the debtor"s business activity, in accordance with article 166 of the Consolidated Spanish text of the Bankruptcy Law (approved by Royal Legislative Decree 1/2020 of s May), financing contracts are expressly included. In such a context, the aim of this article is to analyze the regime for the rehabilitation ot thís type of contracts, distinguishing in this sense the various requirements that must be fulfilled in order to carry out this rehabilitation, as well as the right to object to the rehabílitation of the bankruptcy creditor.
