Resumen de La regulación jurídica de los caminos en los ordenamientos históricos vascos (siglos XIII-XIX)

El presente estudio analiza el origen y desarrollo de la legislación que reguló los caminos de los tres territorios vascos de la Vasconia peninsular (Álava, Guipúzcoa y Vizcaya), tanto en materia de seguridad como de asentamiento de la infraestructura caminera de los mismos (apertura, mantenimiento, limpieza, responsabilidad de su gestión, etc.) desde el siglo XIII hasta la pérdida foral de 1876. Cómo la influencia del Derecho castellano en sus primeros tiempos, especialmente en materia de seguridad, fue dando paso a un desarrollo normativo propio, impulsado por sus juntas territoriales y los propios municipios, de forma similar y paralela, hasta institucionalizar la gestión, con gran madurez, a lo largo del siglo XIX.

Baskonia penintsularreko hiru euskal lurraldeetako –Araba, Gipuzkoa eta Bizkaiko– bideak arautu zituen legeriaren jatorria eta garapena aztertzen ditu azterlan honek, hala segurtasunari dagokionez, nola haietako bide-azpiegituren kokapenari dagokionez (irekiera, mantentze-lanak, garbiketa, kudeatzeko ardura, etab.), XIII. mendetik foruak 1876. urtean galdu ziren arte. Nola Gaztelako zuzenbidearen hasierako eraginak pixkanaka tokia utzi zion berezko arau-garapenari, lurralde-batzarrek eta udalerriek beraiek bultzatuta, era antzeko eta paralelo batez, harik eta, kudeaketa, heldutasun handiz, XIX. mendean zehar instituzionalizatu zen arte.

This study analyses the origin and development of the legislation that regulated the roads of the three Basque territories of Spanish Vasconia (Araba, Gipuzkoa and Bizkaia), both in terms of security and the establishment of their road infrastructure (opening, maintenance, cleaning, responsibility for their management, etc.) from the 13th century until the loss of the fueros in 1876. How the influence of Castilian Law in its early days, especially in matters of security, gave way to their own regulatory development, promoted by their territorial councils and the municipalities themselves in a similar and parallel way, until the institutionalisation of the fully matured systems of management throughout the nineteenth century.
