El derecho a la libertad de creación artística y su singularidad

    La dimensión artística no constituye, actualmente, un elemento relevante en la contextualización y ponderación del derecho a la libertad de creación artística. Sin embargo, no solo la Constitución y la jurisprudencia constitucional le reconocen un carácter autónomo, sino que su propia singularidad, que se desprende de unos rasgos propios que los órganos judiciales pueden apreciar y valorar, exige la construcción de un canon de enjuiciamiento específico que permita aplicar una protección cualificada. En la construcción de ese canon de enjuiciamiento conviene revisar el criterio de la necesidad de las expresiones en relación con el mensaje transmitido, cuya contrapartida (su carácter gratuito) resulta difícilmente apreciable en el marco autorreferencial del fenómeno artístico. No puede obviarse, asimismo, la necesidad de reconfigurar los contornos de los derechos fundamentales en el nuevo contexto que dibuja la sociedad digital, prestando especial atención a la mutación que experimenta la(s) censura(s) y la hiperreacción ante la ofensa.

    The artistic dimension does not currently constitute a relevant element in the contextualization and consideration of the of artistic freedom of expression. However, the Spanish Constitution and constitutional jurisprudence recognize its autonomous character. Its uniqueness is given by its own features that must be valued by the jurisdiction. This requires the construction of a specific valuation canon that allows the application of qualified protection. In the construction of this canon, it is convenient to review the criterion of the need for expressions with respect to the transmitted message, whose counterpart (its gratuitous nature) is difficult to appreciate in the self-referential framework of the artistic phenomenon. Likewise, the need to reconfigure the contours of fundamental rights in the new context drawn by the digital society cannot be ignored, paying special attention to the mutation experienced by censorship(s) and the hyper-reaction to offense
