    El presente artículo intenta examinar cómo –y de hecho si– se puede alcanzar uniformidad en el Derecho del Transporte a nivel universal y, lo que es más importante, si esta uniformidad puede dar lugar a una aplicación transfronteriza. Para ello, en primer lugar, será imprescindible determinar el significado y valor de la uniformidad y, en particular, qué se entiende por tal. Para todo, se presta especial atención al fenómeno uniforme en el Derecho Marítimo, y la adopción normativa en el Derecho Chileno. Finalmente se expresarán los motivos por los cuales es necesaria la uniformidad, y los mecanismos a través de los cuales es posible alcanzarla.

    This article attempts to examine how –and indeed if– uniformity in Transport Law can be achieved at a universal level and, more importantly, if this uniformity can lead to cross-border application. To do this, first of all, it will be essential to determine the meaning and value of uniformity and, in particular, what is meant by such. For all, special attention is paid to the uniform phenomenon in Maritime Law, and the normative adoption in Chilean Law. Finally, the reasons why uniformity is necessary, and the mechanisms through which it is possible to achieve it, will be expressed.
