Resumen de Atribución de ganancialidad, aportación de bienes y derecho de reembolso: encrucijada de negocios jurídicos y su resolución desde la óptica de diez sentencias del Tribunal Supremo

  Cuando un matrimonio se encuentra unido, es frecuente que se realicen confusiones y desplazamientos entre sus respectivos patrimonios y la sociedad de gananciales. Al producirse la ruptura de la pareja, se plantean numerosos problemas relativos a determinar tanto la naturaleza ganancial o privativa de los bienes -en función del carácter de los fondos empleados para su adquisición-, como la procedencia del derecho de reembolso por haber realizado aportaciones de dinero privativo. Se abordan en el presente estudio las diferencias entre la "atribución de ganancialidad", la aportación de bienes -onerosa y gratuita- y los supuestos en los que procede incluir en el pasivo de la sociedad de gananciales un derecho de reembolso por haber aportado dinero privativo para adquirir bienes, para pagar deudas gananciales o por haber ingresado dinero privativo en una cuenta bancaria titularidad de ambos. Se analizan todos estos supuestos desde la óptica de la más reciente jurisprudencia del Tribunal Supremo.

  When a married couple is united, it is frequent that there are confusion and displacements between their respective patrimonies and the community of property. When the couple breaks up, there are numerous problems related to determining both the community or private nature of the assets -depending on the nature of the funds used for their acquisition- and the origin of the right of reimbursement for having made contributions of proprietary money. Are addressed in this study the differences between the "attribution of community property", the contribution of assets -costly and free- and the cases in which it is appropriate to include in the liability of the community property a right of reimbursement far having contributed private money to acquire property, to pay community debts or far having deposited private money in a bank account owned by both. AII these assumptions are analyzed from the perspective of the most recent jurisprudence of the Supreme Court.
