Considerazioni sulla configurabilità del tentativo nel 'reato' abituale

    The question of whether or not the attempt to commit a habitual offense is punishable is highly debated among scholars. The case law appears to be just as controversial, even though recent trends should be noted which — with a view to strengthening repression — do not hesitate to ‘force' the legislation by making the punishable offences compatible with the commission of an attempted crime. Some examples include the illegal practice of a profession, the exploitation of prostitution or family abuse. After discussing the characteristics of habitual offences, this contribution highlights the incompatibility between habitual offences and the attempt to commit them by emphasizing the psychological element of the offence itself. Within the context of the necessarily habitual offence, the Author emphasizes the risk of confusing the intent involved in a habitual offence with the intent in a continuing offence. From a different perspective, the category of possibly habitual offences has an inherent flaw consisting in the contrast between the concepts of ‘habitual' and ‘possibly', which nullifies its very existence.

    La configurabilità del tentativo nell'ambito delle fattispecie abituali è alquanto dibattuta in dottrina. Non minori difficoltà si colgono nell'applicazione giurisprudenziale, anche se vanno segnalati recenti orientamenti che — nell'ottica di una maggiore repressione — non esitano a ‘forzare' il dato normativo rendendo la fattispecie incriminatrici compatibile con il delitto tentato. Valgano gli esempi dell'esercizio abusivo di una professione, dello sfruttamento della prostituzione oppure dei maltrattamenti in famiglia. Il contributo, dopo essersi soffermato sulle caratteristiche del reato abituale, pone in luce, attraverso la valorizzazione dell'elemento psicologico del reato, l'incompatibilità tra delitto abituale e tentativo. In particolare, nell'ambito del reato necessariamente abituale viene rimarcato il rischio di confondere il dolo del reato abituale con il dolo del reato continuato. Da altro punto di vista, la categoria del reato eventualmente abituale ha in sé un vulnus rappresentato dalla contrapposizione dei concetti ‘abituale' ed ‘eventualmente' che ne vanifica qualunque sussistenza.
