  Entre las distintas concepciones sobre los derechos humanos que existen actualmente, la teoría garantista propuesta por Ferrajoli ha encontrado gran aceptación entre las instituciones legalistas de los Estados modernos y aquellos profesionales de la ciencia jurídica. Sin embargo, ¿es esta teoría suficiente para entender la complejidad de los derechos humanos como fenómenos sociales? Como todas las teorías, esta tiene límites que deben ser cuestionados , sobre todo por corresponder más al interés de una minorí a que tiene garantizada de forma material el goce de sus derechos. Una forma de asegurar que el statu quo continúe es a través del uso legítimo de la fuerza que busca frenar las incomodidades sociales y la alteración de la línea vertical de aplicación de la Ley.

  Within the different human rights conceptions currently existing, the guaranties based (garantistic) theory proposed by Luigi Ferrajoli has found wide acceptance between both mod ern states legal institutions and law science professionals. However, is this theory enough to understand on its full the complexity of human rights as social phenomena? Like all theories, this one has its limits and those must be questioned, especially since it was created to protect the interests of a minority that has materially guaranteed the enjoyment of their rights. One way to ensure the continuity of the status quo is through the legitimate use of violence that seeks to break the social discomfort and alteration of the vertical line of law enforcement.
