    Se analiza la influencia de la Carta Social Europea en la jurisprudencia española. Se examina la aplicabilidad directa de la Carta Social Europea, la doctrina del Tribunal Constitucional sobre el control de convencionalidad y la vinculación de las decisiones del Comité Europeo de Derechos Sociales en la jurisprudencia. Se repasa el camino recorrido por los Juzgados de lo Social y la Sala de lo Social de los Tribunales Superiores de Justicia hasta llegar a los recientes pronunciamientos del Tribunal Supremo sobre la aplicación de un instrumento jurídico de contenido tan heterogéneo, como es la Carta Social Europea.

    The influence of the European Social Charter on Spanish jurisprudence is analyzed. The direct applicability of the European Social Charter, the latest doctrine of the Constitutional Court on the control of conventionality and the binding of the decisions of the European Committee of Social Rights in case law will be examined. It reviews the way taken by the Social Courts and the Social Chamber of the High Courts of Justice up to the recent pronouncements of the Supreme Court on the application of a legal instrument with such a heterogeneous content as the European Social Charter.
