La singularidad del modelo contractual alemán de derecho de huelga ha obligado a Alemania a blindarlo frente a diversas normas internacionales, incorporadas al ordenamiento jurídico alemán, con la finalidad de preservarlo. Este blindaje se ha hecho efectivo frente al Derecho social de la Unión Europea, en 1992, y frente a la Carta Social Europea, en 2020. Sin embargo, dicho modelo queda de momento sin blindaje frente al Convenio Europeo de Derechos Humanos, a la espera de lo que decida al respecto el Tribunal Europeo de Derechos Humanos.
The uniqueness of the German contractual model of the right to strike has forced Germany to shield it from various international standards, which have been incorporated into German law in order to preserve it. This shielding was put into effect in the face of European Union social law, in 1992, and the European Social Charter, in 2020. However, for the time being, this model is not shielded from the European Convention on Human Rights, pending the decision of the European Court of Human Rights.
