Los delitos asociativos: algunas consideraciones entre Italia y México

    La presente introspección ofrece algunos elementos dogmáticos y reflexiones generales en torno de los delitos asociativos que se contemplan en la legislación penal tanto en Italia como en México. Se pone especial atención a la modulación legislativa, así como de algunas problemáticas derivadas de su tratamiento específico. Se analiza su forma estructural, los elementos integradores de las conductas típicas de asociación para delinquir y la asociación de tipo mafioso en el caso de Italia; y de pandillerismo, asociación delictuosa y delincuencia organizada en el caso de México. Finalmente, se arriba a la conclusión que se trata de conductas típicas complejas, difusas respecto del bien jurídico tutelado, de alta peligrosidad que trasgreden el Estado de derecho, sobre reguladas, y de tutela excesiva que anticipan un peligro abstracto.

    The present introspection offers some dogmatic elements and general reflections about the associative crimes that are contemplated in the criminal legislation both in Italy and in Mexico. Special attention is paid to legislative modulation, as well as some problems derived from its specific treatment. Its structural form is analyzed, the integrative elements of the typical behaviors of association to commit a crime and the mafia-type association in the case of Italy; and gang activity, criminal association, and organized crime in the case of Mexico. Finally, the conclusion was reached that these are typical complex behaviors, diffuse regarding to the protected legal right, highly dangerous that violate the rule of law, overregulated, and excessive protection that anticipates an abstract danger.
