    Las normas especiales de responsabilidad civil generan un problema de constitucionalidad relativo a las leyes exclusivas o limitativas de responsabilidad civil. Su control, en el único caso planteado ante el Tribunal Constitucional, se ha efectuado a través del análisis del régimen de responsabilidad involucrado. Se critica la vía escogida por la jurisprudencia del Tribunal Constitucional y se propone como mecanismo de control de la constitucionalidad de las leyes exclusivas o restrictivas de responsabilidad la satisfacción de la norma del interés público o general, evitando así privilegios que afecten la igualdad ante la ley.

    The emergence of special rules of civil liability creates a problem of constitutionality, which is that exemption from the liability law, whether they exclude or limit it. Their control, in the only case brought before the Constitutional Court, has been carried out through the analysis of the liability regime involved. The path chosen by the Constitutional Court's jurisprudence is criticized and it is proposed as a mechanism to control the constitutionality of exclusive or restrictive laws of liability to satisfy the rule of public or general interest, thus avoiding privilegesthat affect equality before the law.
