Resumen de Aguas Nacionales: desde la perspectiva de su eficaz protección jurídica en el Derecho Mexicano

  Se parte de la pregunta: ¿Por qué la legislación jurídica mexicana no ha detenido la crisis del agua? En su desarrollo se proyecta el análisis de las disposiciones que regulan los recursos hídricos en el sistema jurídico mexicano y que no han sido suficientes para su eficaz protección y conservación, así como la medida para poder incidir en su atención. Destacando la problemática que emerge de las disposiciones legales orientadas sólo a defender el derecho del gobernado, del usuario de aprovechar, usar y explotar el agua, cuya tutela jurídica no está orientada a la salvaguarda del recurso hídrico, tratándose de normas inflexibles.

  La crisis de la escasez y deterioro del agua ha afectado a varios países del mundo, de la que México no escapa, siendo imperante la creación de instrumentos jurídicos que bajo la rectoría del Estado logren una real defensa de las aguas nacionales, cumplan con el desarrollo sustentable, consideren el agua como fuente de vida, como patrimonio que debe protegerse y defenderse de la degradación antropogénica; traducida en normas vinculantes, coercibles, en un procedimiento especial, hasta la creación de una disciplina jurídica.

  This investigation leaves from the question: Because the Mexican legal legislation it has not stopped the crisis of the water? In their development the analysis of the dispositions projects that regulate the hydric resources in the Mexican system legal and which they have not been sufficient to obtain his effective protection and conservation. Emphasizing the problematic one that it emerges from the legal dispositions oriented to only protect the right of the governed one, of the user to be useful, to use and to operate the water, whose legal protection this oriented does not safeguard to it of the hydric resource, concerning inflexible norms.

  The crisis of the shortage and deterioration of the water has affected several countries of the world, of which Mexico does not escape, having been prevailing the creation of legal instruments that under rectories of the State obtain a real protection of national waters, fulfill the viable development, consider the water like source of life, patrimony that must be protected and be defended of the anthropogenic degradation; translated in linking, coercible norms, in a special procedure, until the creation of one it disciplines legal.
