    • The use of algorithms as a functional strategy puts the institutional decision-making paradigms to test and their endurance in the actual functioning of the institutions. Starting from the appeal exercised by algorithms and the practice of them as vectors of justice, “algocracy”, in fact, becomes an indicator of the tendency towards depersonalization and de-responsibility of institutional powers. From a legal philosophical perspective, the essay highlights the assumptions and the critical profiles of this “exemption”. More specifically, through Gehlen’s theoretical reflection, the article focuses on the need to reach a normative order that contrasts the excessive algorithmic power, proposing solutions focused on the regulatory potential of decision-making processes that move from concrete reality.
