Como era previsible, los detractores de la iniciativa legislativa popular de 2020, que permitía considerar como trabajadores autónomos a los transportistas al servicio de plataformas digitales, impugnaron en 2021 la constitucionalidad de dicha iniciativa, una vez convertida en Derecho positivo. La primera impugnación no prosperó, pues la Corte Suprema de California se declaró incompetente para conocer del asunto. En cambio, la segunda impugnación sí resultó exitosa, habiendo declarado una Corte californiana de primera instancia que la iniciativa popular violaba la Constitución de California. Esta historia judicial no ha terminado.
As it was foreseeable, people contrary to the statute initiative of 2020, allowing to consider the app-based drivers as independent contractors, challenged its constitutionality once passed it into law. The first challenge did not prevail, because the Supreme Court of California declared that it did not have original jurisdiction to adjudge the case. On the contrary, the second challenge was successful, in having considered a Californian trial court that the statute initiative violated the Constitution of California. This judicial story is not over.
