Resumen de Whistleblowing: la tutela del trabajador denunciante en Portugal

: El presente estudio, después de evidenciar los antecedentes de la Directiva europea que se ocupa de la protección de los whistleblowers,analiza los aspectos esenciales de dicho instrumento normativo comunitario, confrontándolo con la ley que, en Portugal, procedió a su transposición en el ordenamiento jurídico nacional. También se tiene en cuenta la incipiente elaboración jurisprudencial del tema en Portugal, a pesar de la existencia de instrumentos internacionales, vinculantes para este Estado, en que los principios y directrices fundamentales a tener en cuenta al abordar la materia ya se encontraban consagrados. La inferencia básica que el estudio posibilita es la de la insuficiencia del régimen legal establecido, para la realización de los objetivos de tutela definidos por la Directiva y sus antecedentes internacionales.

The present essay, after highlighting the antecedents of the European Directive that deals with the protection of whistleblowers, analyzes the essential aspects of this instrument,comparing it with the law that, in Portugal, proceeded to its transposition into the national legal system. The incipient jurisprudential elaboration of the subject in Portugal is also assessed, despite the existence of international instruments, binding for this State, in which the fundamental principles and guidelines to be followed in the approach to the matter were already enshrined. The basic inference that the study makes possible is the insufficiency of the established legal regime, for the accomplishment of the protection objectives defined by the Directive and its international antecedents.
