Resumen de La resocialización en materia de Violencia de género

El presente artículo analiza la política criminal a la resocialización en materia de violencia de género en la legislación española a partir de la Ley Orgánica en adelante LO n.° 1/04 de “Medidas de Protección Integral contra la Violencia de Género”. La sanción de la mencionada ley aparece como consecuencia modificaciones realizadas en el Código español respecto a la descripción típica de la violencia física dada en el ámbito familiar y que tiene como principal víctima a la mujer. Al respecto, la mayoría de los autores sostienen que la violencia ejercida contra la mujer se origina a consecuencia de la histórica desigualdad estructural entre el hombre y la mujer. Es interesante realizar un análisis comparativo de la política criminal paraguaya con la española en razón a la reciente sanción de la Ley n.° 5777/16 de “Protección Integral de las Mujeres, contra toda forma de Violencia”, que posibilite describir si los mecanismos previstos en la citada ley son viables para la resocialización del agresor, o si la socialización preventiva constituye el camino más adecuado para reencausarlo, siempre que se trate de casos de violencia de género.

The present research covers the criminal politics on gender-based violence matters in the spanish legislation, taking as a starting point the Organic Act number 1/04 “Full protection against gender-based violence”. The enacment of the Act appears as the result of several amendments of the spanish Penal Code regarding the common description of psysichal violence within the family, where women are the main victims. In this respect, most of the authors claim that violence against women arises from the historical structural inequality between men and women. For this reason, it is important to conduct a comprehensive comparative study of the paraguayan criminal politics in contrast with the spanish, in view of the recent enactment of the Act number 5777/16 “Full protection for women against all forms of violence”, that enables to describe wether the mechanism set out in the mentioned Act are factible for the sake of the offeder's social rehabilitation, or if the education is the best way to rehabilitate offenders, whenever it is a gender-based violence case.
