Sobre la posibilidad de imponer a los trabajadores la realización de una prueba PCR o la vacunación frente a la covid-19

    Tras la declaración de la pandemia ocasionada por la COVID-19, muchas han sido las dudas generadas en torno a adopción de determinadas medidas que pudieran considerarse ne-cesarias para garantizar el derecho a la vida, a la integridad física y a la salud de toda persona trabajadora. En este sentido, si durante los primeros meses de desescalada, los principales interrogantes gi-raron en torno a la posibilidad de imponer a los empleados la realización de un test de antígenos o PCR, tras el inicio de la campaña de vacunación, son ya muchas las empresas que se preguntan sobre la posibilidad de imponer la inoculación de una vacuna llegado el momento. Así, definir los límites del principio de voluntariedad en una materia como la vigilancia de la salud no es tarea fácil, máxime en un contexto de crisis sanitaria como el actual. Por este motivo se ha escogido la sentencia objeto del presente comentario, porque permitirá repasar el marco normativo de referencia, reflexionar sobre los contornos de la voluntariedad u obligatoriedad de los reconocimientos médicos y responder así a los interrogantes planteados.

    After the declaration of the pandemic caused by COVID-19, there have been many do-ubts generated around the adoption of certain measures that could be considered necessary to guarantee the right to life, physical integrity, and health of every working person.In this sense, if, during the first months of de-escalation, the main questions revolved around the possibility of imposing employees to carry out an antigen or PCR test, after the start of the vaccination campaign, there are already many companies who wonder about the possibility of imposing the inoculation of a vaccine when the time comes.Thus, defining the limits of the principle of volunteering in a matter such as health surveillance is not an easy task, especially in the context of a health crisis such as the current one. For this reason, the sentence that is the subject of this comment has been chosen, because it will allow us to review the normative framework of reference, reflect on the contours of the voluntary or compulsory nature of medical examinations and thus answer the questions raised.
