    The study proposes a constitutional filtering of labor reform, more specifically, a critical analysis of legislative options contrary to the spirit of the Constitution, to the detriment of the principle of the prohibition of social retrogression. At the outset, it will be necessary to historicize the labor reform about the lack of legislative prognosis and the protectionist myth of the Labor Court. In sequence, the unconstitutionalities of Law nº 13.467/2017 are configured, with a view to interpreting the tabulation of compensation for moral damages under the Federal Constitution. In the end, the text verifies the inadequacy between constitutional theory and legislative practice, because the new labor law provokes the phenomenon of “symbolic CLT”.

    O artigo propõe uma filtragem constitucional da Reforma Trabalhista, mais especificamente, uma análise crítica das opções legislativas contrárias ao espírito da Constituição Federal, em detrimento ao princípio da vedação ao retrocesso social. De início, será preciso situar historicamente a Reforma Trabalhista no que se refere à ausência de prognose legislativa e ao mito protecionista da Justiça do Trabalho. Em sequência, pontuam-se as inconstitucionalidades da Lei nº 13.467/2017, numa perspectiva de interpretar o tarifamento do dano extrapatrimonial à luz da CF/88. Ao final, o texto debate a atual inadequação entre a teoria constitucional e a prática legislativa, em virtude da nova lei trabalhista provocar o fenômeno da “CLT simbólica”.
