    El juicio de amparo es un medio de control constitucional y de la convencionalidad en el sistema jurídico mexicano, en su aspecto de juicio de amparo indirecto, es el medio para la defensa de los derechos humanos y sus garantías contra actos de autoridad u omisiones que se realizan en contra del gobernado. Por excelencia, es la vía por el cual un gobernado que ve vulnerado sus derechos humanos o en su defecto alguna garantía jurídica, puede accionar este medio para solicitar se estudie la constitucionalidad o inconstitucionalidad del hecho de autoridad. El juicio de amparo, tiene su origen sobre  el año 1841, idea del político y jurista Manuel Crescencio García Rejón y Alcalá, posteriormente mediante su “voto particular” sentó las bases del juicio de amparo en México el jurista Mariano Otero.
