Los neoconstitucionalismos

    El presente artículo pretende abordar las teorías “neoconstitucionalistas” a partir de precisar el elemento identificatorio de las mismas, y también avanzar en sus distintas versiones reconociendo las tesis carac-terísticas principales de ellas. A la luz de ese objetivo, será posible efectuar un estudio comparativo de las teorías neoconstitucionalistas en orden a descubrir coincidencias y diferencias. Por supuesto que los lími-tes obvios del trabajo, imponen que en el relevamiento de autores, concentraremos nuestra atención cen-tralmente en aquellos más importantes de las perspectivas neoconstitucionalistas analizadas, aunque sin perjuicio de ello, si el tema en cuestión lo amerita, apelaremos circunstancialmente a otros representantes.

    The present article pretends to approach the theories “neoconstitucionalistas” from identifying the iden-tification element of the same, and also advance in its different versions recognizing the main thesis of them. In light of this objective, it will be possible to carry out a comparative study of neoconstitutiona-list theories in order to discover coincidences and differences. Of course, the obvious limits of the work impose that in the authors’ survey, we will focus our attention centrally on those most important of the neoconstitutionalist perspectives analyzed, although without prejudice to this, if the subject in question merits it, we will appeal circumstantially to other representatives.
