    El presente trabajo analiza la reforma del derecho a la dispensa del deber de declarar operada por la Ley Orgánica 8/2021, de 4 de junio, de protección integral a la infancia y la adolescencia frente a la violencia y que intenta clausurar, por fin, la discusión doctrinal y jurisprudencial surgida en torno al reconocimiento de este derecho a las víctimas de violencia de género. No obstante, no son pocos los problemas que sigue generando la nueva regulación, con una delimitación de las condiciones necesarias para el ejercicio del derecho que confrontan con el contenido esencial del derecho a la tutela judicial efectiva de las víctimas. Al mismo tiempo, se atiende a la violencia vicaria, poniendo especial énfasis en lo que se refiere al deber de denunciar y declarar que recae sobre las madres, incluso, cuando se desarrollan en un contexto de violencia compartido.

    This paper analyses the reform of the right to exemption from the duty to testify introduced by Organic Law 8/2021, of June 4, on the comprehensive protection of children and adolescents against violence, which attemts to finally close the doctrinal and jurisprudential discussion that has arisen around the recognition of this right for victims of gender-based violence. However, the new regulation continues to generate a number of problems, with a delimitation of the conditions necessary for the exercise of the right that clashes with the essential content of the victims’ right to effective judicial protection. At the same time, attention is paid to vicarious violence, placing special emphasis on the duty to report and declare that falls on mothers, even when they take place in a context of shared violence.
