Resulta paradójico que el pactum de retrovendendo (utilizado a lo largo de los siglos como garantía crediticia) haya tenido un escaso tratamiento en las fuentes, a pesar de que Roma careció de un crédito territorial y de un sistema hipotecario tan sólidos como los modernos. Partiendo de esta aparente contradicción, el presente trabajo pretende abordar el alcance y efectos del pactum de retrovendendo con el objetivo de poder explicar las causas de su limitada utilización en Roma.
It is paradoxical that the pactum de retrovendendo (used over the centuries as a credit guarantee) has not been widely discussed in the Roman sources, despite the fact that a mortgage system as solid as the modern one did not exist in Rome. Starting from this apparent contradiction, this paper aims to address the scope and effects of the pactum de retrovendendo with the target of explaining the causes of its limited use in Rome.
