Resumen de Deficiência em Conflito: mutações constitucionais sobre os direitos das pessoas com deficiência pós 1988

  Os direitos das pessoas com deficiência estão incluídos em vários instrumentos normativos internacionais, nacionais, gerais e específicos. Todas as normas do ordenamento jurídico brasileiro devem ter compatibilidade com a Constituição Federal, que atua como norma fundamental de natureza política e jurídica do Estado. Todavia, a Constituição não é hermética, mas dinâmica e deve atualizar-se a novos direitos e percepções sobre os sujeitos, a tal processo denomina-se de mutação constitucional. Nesse sentido, o problema da pesquisa é: ocorreram mutações constitucionais referentes aos direitos das pessoas com deficiência no seio da Constituição vigente de 1988? A hipótese levantada é que coexistem no sistema constitucional três modelos (biomédico, social e biopsicossocial) e dois paradigmas (integração e inclusão). A metodologia de revisão integrativa de literatura sob um enfoque analítico permite expor e problematizar as alterações informais sobre os direitos das pessoas com impedimento no Brasil nas três esferas do poder estatal.

  The rights of persons with disabilities are included in several international, national, general and specific normative instruments.  All the legal norms of the Brazilian legal system must be compatible with the Federal Constitution, which acts as a fundamental norm of a political and legal nature of the State.  Notwithstanding, the Constitution is not hermetic, in that sense, being dynamic, must be updated to new rights and perceptions about the subjects. This process is called constitutional change.  In this regard, the research problem is: have there been constitutional changes concerning the rights of people with disabilities within the current Constitution of 1988?  The hypothesis raised is that three models (biomedical, social and biopsychosocial) and two paradigms (integration and inclusion) coexist in the constitutional system.  The methodology of integrative literature review under an analytical approach allows exposing and problematizing informal changes on the rights of people with disabilities in Brazil acording to the three spheres of state power.
