  This article intends to analyze the union legal assistance institute as an effective tool for the concrete access to justice. To develop it, we carried out a critical analysis of the available literature and the study of the pertinent constitutional and legislative provisions. The importance of the study lies in the pressing need to implement means that can guarantee real access to justice, especially for the low-income. The main conclusion of the work is that union assistance has an essential role in the context of a Democratic Rule of Law, as a guaranteeing mechanism of material equality and other fundamental rights of workers.

  O presente artigo pretende analisar o instituto da assistência jurídica sindical como uma efetiva ferramenta para a concretude do acesso à justiça. Para desenvolvê-lo, realizamos a análise crítica da literatura disponível e o estudo dos preceitos constitucionais e legislativos pertinentes. A importância do estudo está na premente necessidade de implantação de meios que possam garantir o real acesso à justiça, notadamente da parte hipossuficiente. A principal conclusão do trabalho é a de que a assistência sindical ostenta papel essencial no contexto de um Estado Democrático de Direito, enquanto mecanismo garantidor da isonomia material e dos demais direitos fundamentais dos trabalhadores.
