    O extrativismo mineral cresceu fortemente na última década no Brasil. Diante disso, o governo brasileiro pretende renovar o marco regulatório da mineração no país. Apesar do sigilo em torno das propostas do governo, já se sabe que o novo código tem como principais intuitos a expansão do extrativismo mineral e o aumento da captura de renda minerária, ignorando os imensos impactos sobre as comunidades atingidas, o meio ambiente e a tendência à reprimarização econômica que tendem a se intensificar. Nesse sentido a aprovação de um novo código pode significar um retrocesso ao invés de um avanço. Este artigo tenta esboçar horizontes alternativos, desde um ponto de vista da justiça socioambiental, para um marco regulatório da mineração que signifique, de fato, um avanço na regulamentação pública do setor mineral.Palavras-Chave: Código da Mineração, Mineração, Renda minerária, Meio ambiente, Justiça socioambiental, Brasil

    ABSTRACT NEW MINING CODE: FORWARD OR BACKWARDMining extrativism have grown strongly during the last decade in Brazil. Under this situation, Brazilian government intends to rebuild the mining regulation system in the country. Despite the secrecy around the government proposals, it is known that the main motifs of the new rules are the expansion of mining extrativism and the increase of the appropriation of mining profits, ignoring the huge impacts over stricken communities, the environment and the tendency to reprimarize the economy, all of which tend to be more and more intense. In this sense, approving a new rule system can mean a backward step in stead of a step forward. The intention of this article is to draw alternative horizons, from a socio-ambientalist justice point of view, for mining regulation systems that may mean, in fact, a step forward in public regulations of the mining sector.Key Words: Mining Code, Mining, Environment, Mining, Mining Taxes, Environmental Justice, Brazil
