Resumen de Fundamento Legal de la Convivencia Escolar Aplicado en los Manuales de Convivencia-Instituciones Educativas del Municipio de Sogamoso, Boyacá

  El propósito de este artículo es hacer un análisis de los fundamentos jurídicos de la convivencia escolar en Colombia aplicada en los manuales de convivencia de las instituciones educativas del Municipio de Sogamoso, en los que se han originado errores de implementación, interpretación y aplicación cuando se abordan problemáticas de agresiones entre los integrantes de la comunidad educativa. Se abordarán los aspectos generales de la convivencia escolar, el análisis de las fuentes jurídicas, la importancia de los Manuales de Convivencia y las falencias en su elaboración; finalmente se muestra una propuesta para materializar el derecho sustancial cuando se vulneran Derechos Humanos en la convivencia escolar. Se determinó que existen imprecisiones en la aplicación de la norma al igual que vacíos jurídicos que conllevan a que la convivencia como política no se materialice efectivamente en las aulas de clase.

  The purpose of this reflection is to make an analysis of the legal fundamentality of school coexistence in Colombia applied in the coexistence manuals of the educational institutions of the Municipality of Sogamoso, which have resulted in multiple errors of implementation, interpretation and a main compilation of the technical and legal shortcomings that are presented when addressing issues of aggression among members of the educational community.It contains at the time of applying the route of attention to solve the behaviors that affect school life and contents analysis of the rulebooks. In this article of reflection it will be analyzed the general aspects of school coexistence, the analysis of legal sources, the importance of the rulebooks and the shortcomings in its elaboration, a proposal to make a reality the substantial Law when human rights are violated in the school coexistence. Concluding that there are many inaccuracies in the application of regulations as well as legal voids that lead to the coexistence as a policy that does not materialize effectively in classrooms.
