El debate en torno a la imparticio?n o administracio?n de justicia en Colombia ha tomado diversos rumbos y ha sido abordado desde diversas posturas. Por una parte, entender que la ponderacio?n o valoracio?n de los derechos debe darse bajo el entendido de la administracio?n para que se de? un orden ubicari?aal juez como un administrador de justicia; por otra parte, entender al juez como inte?rprete de la norma ma?s alla? de su tenor literal y asi? aplicarla en un sentido ma?s amplio pero racional dentro de la discrecionalidad lo ubicari?a como impartidor de justicia. Asi? las cosas, este escrito retoma el debate cla?sico sobre el rol del juez impartidor o administrador de justicia, abordando el problema de la interpretacio?n del derecho y su incidencia en la aplicacio?n y materializacio?n de la justicia ma?s alla? del frio papel a lo largo de la historia y en el marco de un Estado Social de Derecho para la resolucio?n de problemas juri?dicos.

Abstract The debate surrounding the delivery or administration of justice in Colombia has taken different courses and has been approached from different positions. On the one hand, to understand that the weighting or valuation of rights must be given under the understanding of the administration so that an order is given would locate the judge as an administrator of justice; On the other hand, to understand the judge as interpreter of the norm beyond its literal tenor and thus apply it in a broader but rational sense within the discretion would place him as a justice provider. Thus, this paper takes up the classic debate on the role of the judge or administrator of justice, addressing the problem of the interpretation of law and its impact on the application and realization of justice beyond the cold paper throughout the history and within the framework of a Social State of Law for the resolution of legal problems.
