    Este trabajo tiene por objeto analizar la asunción cumulativa de deuda ajena, una construcción doctrinal y jurisprudencial que toma como punto de partida la asunción de deuda liberatoria y descansa sobre la base del principio de autonomía de la voluntad. En particular, el estudio persigue demostrar que existe una distancia insalvable con la novación «modificativa» y una cercanía tal con el régimen jurídico de la fianza y de las obligaciones solidarias que hace cuestionar el sentido de su misma existencia.

    The purpose of this paper is to analyze the cumulative assumption of someone else's debt, a doctrinal and jurisprudential construction that takes as its starting point the assumption of dischargeable debt and rests on the basis of the principle of autonomy of the will. In particular, the study seeks to demonstrate that there is an insurmountable distance with the «modifying» novation and such a closeness with the legal regime of guarantee and joint and several obligations that the meaning of its very existence is questioned.
