Resumen de Além das mãos: marcos legais da inclusão do surdo no contexto educacional

  The present article was elaborated with the objective of identifying the advances of the Brazilian legislation that allowed the educational inclusion of the deaf. In view of the need for public policies so that the deaf person can enjoy their fundamental rights, including the right to education, it is important to discuss this topic for the knowledge and enforcement of current laws. Therefore, the methodology used was the literature review, which enabled the analysis of current legislation, as well as articles and works on the subject. With the recognition of the Brazilian Sign Language - Libras, as one of the official languages of Brazil, a trajectory through the history of deaf education began, concomitantly with the deaf culture. In the midst of this trajectory, public policies aimed at the inclusion process emerge, addressed here with a specific focus on the school inclusion of the deaf. In this way, it is questioned about the education of the deaf as a being of law and supported by laws that provide for their inclusion and the right of educational and social communication in regular education, that is, assuring them the right to bilingual education and the particularities of their needs, for example, teaching Libras as a first language.

  O presente artigo foi elaborado com o objetivo de identificar os avanços da legislação brasileira que permitiram a inclusão educacional dos surdos. Tendo em vista a necessidade de políticas públicas para que a pessoa com surdez possa gozar de seus direitos fundamentais, entre eles o direito à educação, nota-se a importância da discussão deste tema para conhecimento e execução das leis vigentes. Para tanto, a metodologia utilizada foi a revisão bibliográfica, que possibilitou a análise da legislação vigente, assim como artigos e obras sobre a temática. Com o reconhecimento da Língua Brasileira de Sinais - Libras, como uma das línguas oficiais do Brasil, iniciou-se uma trajetória pela história da educação de surdos, concomitantemente à cultura surda. Em meio a essa trajetória surgem as políticas públicas voltadas ao processo de inclusão, aqui abordada com enfoque específico na inclusão escolar do surdo. Desse modo, questiona-se sobre a educação do surdo enquanto ser de direito e amparado por leis que preveem sua inclusão e o direito da comunicação educacional e social no ensino regular, ou seja, assegurando-lhe o direito à educação bilíngue e as particularidades de suas necessidades, como exemplo, o ensino da Libras, como primeira língua.
