  Es una cuestión muy debatida la de si la llamada intervención humanitaria (replanteada en el Derecho internacional contemporáneo como responsabilidad de proteger) constituye un supuesto de uso legítimo de la fuerza. Sin negar que, en situaciones límite, puede admitirse la legitimidad del recurso a la fuerza armada para proteger a las poblaciones en peligro, el objetivo del trabajo es defender la necesidad de profundizar en la responsabilidad de prevenir como alternativa al uso de la fuerza.

  It is a question particularly debated whether the so-called humanitarian intervention (re-invoked in contemporary international law as a responsibility to protect) constitutes an assumption of legitimate use of force. Without denying that, in extreme situations, the legitimacy of using armed force to protect populations at risk can be admitted, the paper defends the need to deepen the responsibility to prevent as an alternative to the use of force and, where appropriate, as a condition of legitimacy of the latter. And it is argued that this thesis is consistent with the doctrinal origins of the humanitarian intervention in the thought of Francisco de Vitoria and with its current reformulation as a responsibility to protect.
