    Il saggio analizza il problema relativo al riconoscimento dello “status filiationis” in Italia di un bambino nato, non in Italia, a seguito di una tecnica di procreazione medicalmente assistita tra due persone dello stesso sesso. Ricostruita l’evoluzione giurisprudenziale italiana ed europea sul tema, l’attenzione è tesa ad individuare una possibile tutela giuridica.

    The essay analyses the problem regarding to the recognition of the “filiationis status” in Italy, of a child born, not in Italy, following a medically assisted procreation technique between two persons of the same sex. Reconstructed the evolution of the case-law in Europe and in Italy, the Author attemps to give a solution to the protection of the best interests of the child.
