Resumen de Direito e tecnologia “em” interregno: a regulação como problema!

  The proposed work aims to question the conditions and possibilities of Rule of Law as an expression of public authority to act and function as a skillful instrument to effectively regulate such relations – between Law and Technology, especially considering the transformations and impacts produced by the Internet Revolution in contemporary societies, responding to emerging conflicts in this context. To answer these and other questions, the hermeneutic-phenomenological approach method was used, through the interpretative reflection on the object and the context, seeking to highlight the contradictions between what the theory says, the law and what the concrete reality presents. Bibliographic and documentary research was used, noting there is a need for a regulation beyond the state that can more effectively establish regulatory parameters that dialogue with civilizing achievements and, above all, with human rights.

  O trabalho proposto objetiva interrogar acerca das condições e possibilidades de o Direito como expressão da autoridade pública atuar e funcionar como instrumento hábil para regular eficazmente tais relações – entre Direito e Tecnologia, especialmente considerando as transformações e os impactos produzidos pela Revolução da Internet nas sociedades contemporâneas, respondendo aos conflitos emergentes neste âmbito. Para responder a essas e outras questões, foi utilizado o método de abordagem hermenêutico-fenomenológico, através da reflexão interpretativa sobre o objeto e o contexto, buscando-se evidenciar as contradições entre o que diz a teoria, a lei e o que a realidade concreta apresenta. Utilizou-se a pesquisa bibliográfica e documental, constatando-se a necessidade de uma regulação supraestatal que poderá, de forma mais eficaz, estabelecer parâmetros regulatórios que dialoguem com as conquistas civilizatórias e, sobretudo, com os direitos humanos.
