Resumen de Los bancos de mitigación en EE.UU.: Orígenes y evolución de esta forma de compensación ambiental

EE.UU. es el pionero en la implantación de los bancos de mitigación, primero con los Wetland mitigation banking y bastantes años después con los Conservation banking. Pese a referirse a ámbitos distintos, ambas modalidades tieNen en común la búsqueda de no pérdida neta de la biodiversidad, implicando para ello al mercado, cuando el desarrollo de planes o proyectos requieren la generación de daños ambientales permanentes. Su regulación ha ido evolucionando hasta establecerse la preferencia de esta forma de compensación frente a las otras dos posibles vías: In-Lieu Fee Mitigation y Permittee-Responsible Mitigation. En este trabajo se analizan los orígenes y la evolución de estas formas de compensación ambiental.

The USA is the pioneer in the implementation of mitigation banks, first with Wetland mitigation banking and a few years later with Conservation banking. Although they refer to different fields, both modalities have in common the search for no net loss of biodiversity, involving the market for this purpose, when the development of plans or projects requires the generation of permanent environmental damage. Their regulation has evolved to the point of establishing the preference of this form of compensation over the other two possible methods: In-Lieu Fee Mitigation and Permittee-Responsible Mitigation. This paper analyses the origins and evolution of these forms of environmental compensation.
